1. INTRODUCTION AND ETHOS Welcome to the 434. By securing your Legacy Number you are entering into an agreement with Westernport Whisky (trading as Gippsland Distilling Company). These terms define the privileges of your membership and the strict responsibilities required to maintain your position in the club.

We have built this club to reward active enthusiasts and collectors. The following guidelines ensure that our limited stock reaches those who value it most.

 

2. THE LEGACY NUMBER Upon acceptance into the club we will allocate you a specific Legacy Number between 1 and 434.

• Allocation: This number is exclusive to you for as long as your membership remains active.
• The Promise: We guarantee that for every official “Club Release” (typically three per year) the bottle bearing your specific Legacy Number will be reserved for you for a period of 7 days.
• Bottle Specifics: While we take every care to ensure your number is hand-penned on your allocated bottle we reserve the right to supply a replacement unnumbered bottle or refund the purchase price in the unlikely event of breakage or production error.

 

3. MEMBERSHIP ACTIVATION & THE FOUNDER’S KIT

• Joining Fee: A one-time non-refundable Activation Fee is required to secure your number and enter the registry.
• The Founder’s Kit: Your official Welcome Kit (containing your Certificate of Registry and glassware) will not be shipped separately; it will be dispatched within the same package as your first purchased Club Release bottle.
• Waitlist: If the club is at capacity (434 members) new applicants will be placed on a Priority Waitlist. We offer vacated numbers to the waitlist on a strict “first-come first-served” basis.

 

4. THE “ACTIVE COLLECTOR” RULE (PURCHASING OBLIGATIONS) To maintain the integrity of the club and fairness to the waitlist we require members to be active participants. We cannot hold allocated numbers for inactive accounts.

• The Release Window: When a new whisky is released we will notify you via email and/or SMS. You have a strict 7-day exclusive window to purchase your numbered bottle.
• Missed Purchase: If you do not purchase your bottle within the 7-day window your “Right of First Refusal” for that specific release expires. We will then offer that bottle to our Waitlist.
• Forfeiture of Number: If you fail to purchase two (2) consecutive Club Releases your membership will be deemed dormant. We reserve the right to cancel your membership immediately, revoke your Legacy Number and offer it to the next person on our waitlist.
• Consequence of Non-Payment: If payment is not captured within the window you will not receive your allocated bottle for that release. Continued non-payment will result in the permanent loss of your Legacy Number.

 

5. PRICING AND INCLUSIONS

• Standard Club Pricing: The standard price for a Club Release is currently set at $295.00 AUD.
• Inclusions: This price is fully inclusive of:
  • Your 700ml hand-numbered bottle of an exclusive 434 Legacy Club Single Malt.
  • A 50ml “Distiller’s Sample” of the same liquid (allowing you to taste the whisky without breaking the seal on your main bottle).
  • Express Shipping and Insurance anywhere within Australia.
• Price Adjustments: We reserve the right to adjust pricing for future releases based on the age and rarity of the spirit. Members will always be notified of the price prior to the release window opening.

 

6. SHIPPING AND DELIVERY

• Australia Only: At this stage the 434 Club ships exclusively to addresses within Australia. We do not currently offer international shipping.
• Dispatch: All orders are shipped via our courier partners. Dispatch times will be communicated upon the closure of the release window.
• Consolidated Shipping: To ensure the safety of your items your Founder’s Kit (glassware and certificate) will be packed and shipped alongside your first bottle order.

 

7. TRANSFER AND INHERITANCE Your Legacy Number is an asset and we allow it to be transferred under specific conditions.

• Transfer: You may transfer your number to a family member or friend by providing us with a written request. The new holder must agree to these Terms of Service.
  
• Inheritance: In the event of a member’s passing the Legacy Number can be bequeathed to a beneficiary. Please have the executor of the estate contact us to arrange the transfer of the account.

• Gift: If you have purchased a membership on behalf of someone else (gifted) they will receive all the rights as per these Terms and Conditions. If they are not advised of the continuation and payment options then they will lose all rights as if they had applied and acquired a number for themselves. 

• Approval: We reserve the right to reject a transfer if we suspect the account is being used for commercial flipping or scalping purposes.

 

8. CANCELLATION You may cancel your membership at any time by notifying us in writing. Upon cancellation:

• You forfeit all rights to your Legacy Number immediately.
• We will re-allocate your number to a new member from the waitlist.
• Once a number is may not be retrievable as it will be made available to the next person on the Waitlist.

 

9. BREAKAGE AND RETURNS

• Damage in Transit: If your bottle arrives broken you must notify us within 24 hours of delivery with photographic evidence.
• Replacement of Numbered Bottles: Because each bottle is unique we cannot replace a broken bottle with the same number. In this event we will offer a replacement unnumbered bottle (if stock permits) or a full refund.

 

10. PRIVACY We respect your privacy. Your personal details are used solely for the administration of the club, processing orders and communicating distillery news. We will never sell your data to third parties.
